HOW TO FILE FOR DIVORCE IN WYOMING

- STEP BY STEP GUIDE -

STEP 1 - 2 ways to download the required Wyoming divorce papers:

STEP 2 - The Spouse that has decided to file for divorce must complete the following forms and file with the Court Clerk's Office in the County where you reside:

  • Complaint For Divorce
  • Civil Cover Sheet
  • Vital statistics Form
  • Summons
  • *Bring a check *You may want to call the clerk to see what the filing fee is for your county (See List).

STEP 3 - You must SERVE your spouse of the filing by sending copies of the filed documents (above) as well as:

  • Acknowledgment and Acceptance of Service

You will need to get the above Acknowledgment and Acceptance of Service completed from your spouse and file with the clerk's office along with the original Summons.

REQUIREMENTS

  • Either party must be a resident of Wyoming for at least 2 months.
  • The most common form of filing for divorce is on the grounds of 'Irreconcilable Differences that led to the Breakdown of a Marriage'.

HOW LONG DOES IT TAKE?

STEP 4 - You should give your spouse the Defendant Divorce Papers Kit included in the blank divorce papers in Step 1. Your spouse will have to file the Answer form within 20 days of being served papers by you.

*Within 30 days of serving your spouse. The both of you must trade the Confidential Financial Affidavit.

STEP 5 - File the Affidavit for Divorce Without Appearance of Parties. It can take up to a week to have the Judge sign you Divorce Decree. You will have to call the clerk from time to time to see if the Divorce Decree has been stamped and filed. At this time, your divorce is complete in the State of Wyoming.
