HOW TO FILE FOR DIVORCE IN IDAHO

- STEP BY STEP GUIDE -

STEP 1 - 2 ways to download the required Idaho divorce papers:

STEP 2 - The person that has decided to file for divorce must fill out the following forms and submit to the Idaho Circuit Court Clerk's Office in your county (Find Here):

  • Child Support Affidavit
  • Child Support Worksheet
  • Complaint For Divorce (if you have children)
  • Complaint For Divorce (With no Children)
  • Divorce Summons
  • Parenting Plan
  • Pay filing fee of either $76.00-$129.00 depending on your county.

***If you have children the clerk will provide you with a certificate to attend parental classes. This class must be completed before your final hearing.

STEP 3 - Now it is the time to serve your spouse. You must serve your spouse the following forms

  • Acknowledgement of Service by Defendant and Consent
  • Certificate to Enter Parental Program
  • Child Support Affidavit
  • Child Support Worksheet
  • Complaint For Divorce (*if you have children)
  • Complaint For Divorce (With no Children)
  • Divorce Summons
  • Parenting Plan

REQUIREMENTS

  • Either party must be a resident for at least 6 weeks.
  • Reason for divorce must be either for 'irreconcilable differences'.

HOW LONG DOES IT TAKE?

  • A divorce in Idaho takes a minimum of 4-6 Months..

 

STEP 4 - You will have to wait to receive the Acknowledgement of Service by Defendant and Consent, once you get it back from your Spouse, you will need to file it with the clerk's office.

STEP 5 - You and your Spouse will need to wait 20 days and complete the following forms in the meantime:

  • Child Support Transmittal
  • Divorce Decree
  • Sworn Stipulation for Entry of Decree of Divorce

File these forms to the court and be sure to bring copies as well as 2 stamped envelopes which one will have your address and one your spouses'. You will be notified of your court hearing date.

STEP 6 - You and your spouse must go to your hearing, upon successful completion of all the steps and hearing is completed, the Judge will authorize your Divorce Decree.
