HOW TO FILE FOR DIVORCE IN ARIZONA

- STEP BY STEP GUIDE -

STEP 1 - 2 ways to download the required Arizona divorce papers:

STEP 2 - The spouse that has decided to file for divorce must fill out the following forms:

  • *Affidavit of Minor Children
  • Family Court Cover Sheet
  • Notice Regarding Creditors
  • Notice of Right to Convert Health Insurance Coverage
  • Petition for Dissolution of Non-Covenant Marriage (*With -or- Without Children)
  • *Parent Information Program Order and Notice
  • Preliminary Injunction Form
  • Sensitive Data Sheet
  • Summons

*IF YOU HAVE MINOR CHILDREN

STEP 3 - You will need to submit all the above forms (make 4 copies) with the Superior court clerk's office. After filing (and paying the filing fee) you will be required to submit copies of all the forms to your spouse including the Acceptance of Service form. Be sure to keep the receipt of payment of filing fee.

STEP 4 - You will need to get the Acceptance of Service form completely filled in back from your spouse and file it with the clerk along with the original Summons.

IF YOU HAVE MINOR CHILDREN - You need to fill out the following forms with your spouse in addition to the forms mentioned above:

  • Order of Assignment
  • Parents Worksheet for Children
  • Parenting Plan for Joint Custody

Both spouses need to attend child education classes within 45 days of filing the above forms. The clerk will direct you to the court approved classes in your area, upon completion, you will both be given 'Certificate of Course Completion' that must be filed with the clerk.

REQUIREMENTS

  • Either party must be a resident for at least 3 months.
  • The only cause for divorce besides adultery and imprisonment is that the husband and wife must be separated for at least 12 months.

HOW LONG DOES IT TAKE?

  • A divorce in Arizona takes a minimum of 3 months

STEP 5 - Meet with your spouse, fill out and sign (in front of a Notary) the Consent Decree of Dissolution of Marriage. You will need to have 2 pre-addressed and stamped envelopes for each of the spouses' address.

You will then need to wait 64 days from the time you filed all the forms in Step 2 in order to get a hearing date.You will be notified of the court hearing date either at the time of filing or it will be sent to you in the mail.

STEP 6 - Go to your court hearing and if you have followed all the steps correctly you will receive a signed Divorce Decree from the Judge. Your divorce in Arizona is now complete.
